Learning Objectives
By the end of the course, delegates will be able to:
- Explain the legal framework governing disciplinary and grievance procedures, including the Employment Rights Act 1996, the ACAS Code of Practice on Disciplinary and Grievance Procedures and the consequences of failing to follow it
- Conduct a fair, structured and impartial investigation into a disciplinary matter; including planning the investigation, taking witness statements and writing a clear investigation report
- Issue legally compliant disciplinary invitations and conduct hearings at the appropriate stage of the process
- Manage the right to be accompanied at disciplinary and grievance hearings
- Apply the correct sanction; first written warning, final written warning, or dismissal and understand the evidential threshold for each
- Draft clear, accurate and legally defensible outcome letters
- Understand the threshold for gross misconduct and summary dismissal and apply it consistently and defensibly
- Receive, acknowledge and investigate employee grievances in a timely, consistent and legally compliant manner
- Identify and manage situations where a grievance and a disciplinary matter overlap or run in parallel
- Recognise the most common procedural errors that lead to tribunal findings and understand how to avoid them
- Manage appeals fairly, including the requirement for a more senior or independent manager to hear the appeal
